What Is The Grace Period After My UAE Visa Expires Or I Change Visa

This is one of the most misunderstood topics for residents of the UAE. The rules have changed several times in the last few years, so here is the current position in plain English.

The headline rule

If your UAE residence visa is cancelled or expires, you currently have a grace period of up to one hundred and eighty days to either renew your visa, switch to a new visa sponsor, or leave the country. Before 2022 the grace period was thirty days. The change to one hundred and eighty days has been a major improvement for residents in transition.

When the grace period starts

The clock starts on the date your residence visa is officially cancelled in the ICP or GDRFA system, not the day your employment ends and not the day your passport stamp expires. If your employer drags their feet on cancelling, your grace period starts late.

What you can do during the grace period

  • Stay in the UAE legally without an active residence visa.
  • Apply for a new employment visa with a different employer.
  • Apply for a freelance permit, investor visa or partner visa.
  • Apply for a golden visa or green visa if you qualify.
  • Apply for a property based residence visa if you own qualifying real estate.
  • Travel in and out of the country, but be aware that re entry on a visit visa restarts a different clock.

What you cannot do

  • You cannot work for a new employer until your new work permit is issued, even if you are inside the grace period.
  • You cannot sponsor family members, because your sponsorship lapses with your visa.
  • You cannot open or operate a UAE bank account that requires an active residence visa.

Overstay fines

If you stay beyond the grace period without a new visa or an exit, the overstay fine is AED 50 per day, starting from day one hundred and eighty one. There is also a small service fee on top. Overstay fines must be cleared before you can leave the country or obtain a new visa.

What about a tourist visa overstay

A tourist or visit visa is different. Once your visit visa expires, the overstay fine is AED 50 per day from day one, with no grace period. Always check the exact expiry date on your entry stamp.

What about golden visa holders

Golden visa holders have a ten year residence and far more flexibility. You do not lose your golden visa if you change jobs, lose a job or spend long periods outside the country. The only ways to lose it are voluntary cancellation, criminal conviction or failing to maintain the qualifying conditions (for example selling the property that qualified you).

Practical advice

Always cancel your old visa before applying for a new one, do not let it run concurrently. Always check the cancellation status on the ICP app yourself, do not rely on the PRO.
